Terms of service

These terms govern your salon’s use of MiSuite, supplied by MiSuite Pty Ltd, a company based in Sydney, New South Wales (“we”, “us”). By creating an account or using MiSuite, the business that does so (“you”) agrees to them.

MiSuite is supplied to businesses. If you are a customer of a salon that uses MiSuite, these terms are not your agreement — your agreement is with that salon. How we handle your information is set out in our privacy policy.

1. What MiSuite is

MiSuite is software for running a beauty or nail salon: point of sale, bookings, a walk-in queue, gift cards, packages and memberships, loyalty, staff rostering, time recording, commission and reporting. It is provided as a subscription service over the internet, comprising the Mi POS, Mi Beauty, Mi Staff and Mi Check-In apps, your booking page and the manager dashboard.

What it is not. MiSuite is not an accounting system, not a payroll system, and not tax, legal or employment advice. It produces figures — GST, commission, hours, base pay — from what you enter, for you or your accountant to use. It is not a payment provider: card processing is performed by third parties under your own agreements with them.

2. Your account and your people

You are responsible for everything done under your account, including by your staff. You must give each person their own sign-in rather than sharing one, keep manager PINs confidential, and remove access promptly when someone leaves. If a device is lost, sign it out from the dashboard immediately.

You are responsible for the accuracy of what you enter: your prices, rosters, catalogue, staff records and customer records. We do not check them and cannot know when they are wrong.

3. Trial and fees

Each shop you activate begins with a free trial period. After it ends, that shop is billed on a subscription, per shop, monthly in advance. Fees, the trial length and the billing date are those set out when you subscribe.

A shop only becomes billable once it is activated — by taking its first completed sale, or by switching online booking on. A shop created by mistake and removed the same day is never activated and never charged.

Subscription payments are processed by Stripe. If a payment fails we will attempt to contact you and may suspend the shop’s access until it is resolved. Fees are exclusive of GST unless stated otherwise, and GST is added where it applies.

You may cancel a shop’s subscription at any time, effective at the end of the current billing period. We do not refund part periods except where the Australian Consumer Law requires it.

4. Payments you take from your customers

Money your customers pay online — deposits, gift cards bought on your booking page, no-show fees — is your money and settles to your bank account, through your own connected Stripe account. The receipt and bank statement carry your salon’s name, the transaction is yours, and any chargeback or dispute is yours to answer.

It follows that the GST, consumer-law and stored-value obligations attaching to those sales are yours, not ours. We may charge a platform fee on such transactions where that has been agreed with you in advance; if we do, it is refunded proportionally when you refund the customer.

Card-present payments at the counter run on your own terminal under your own agreement with the terminal provider. Where MiSuite records a card sale taken on a separate terminal, it is recording what you tell it, not processing the payment.

5. Gift cards, deposits and no-show fees

Gift cards you issue are your liability to honour, including if you close a shop or leave MiSuite. MiSuite enforces the three-year minimum expiry required by the Australian Consumer Law and records every issue and redemption on a ledger that cannot be altered after the fact, so that a balance can always be explained. Choosing where a card can be redeemed is your decision and your promise to the customer.

Deposits, cancellation terms and no-show fees are your policy. MiSuite lets you set them, records the exact wording each customer agreed to at the time of booking, and will not charge a no-show fee unless the reminder that warned of it was actually delivered. Whether your policy is fair and lawful — including under the unfair contract terms provisions of the Australian Consumer Law — is your responsibility, and we recommend you take advice on it.

6. Messages to your customers

MiSuite sends texts, emails and push notifications to your customers on your behalf and in your name. You are the sender for the purposes of the Spam Act 2003 (Cth). You must only send marketing to customers who have consented, and you must honour every withdrawal of consent.

MiSuite records consent separately for each channel, processes STOP replies automatically, and stops sending to a number or address after repeated delivery failures. These are safeguards, not a substitute for your own compliance. Texts are charged to your account where your plan meters them, and you can set a monthly cap.

7. Your data

Your data is yours. Your catalogue, customers, sales, staff records and reports remain your property. We claim no ownership of them and do not sell them, share them with other salons, or use them to train machine-learning models.

We process your data to provide the service, to support you when you ask, and where the law requires. Our staff can view your data when you ask for help, and every such access is recorded. Data is hosted in Australia, in Microsoft Azure’s Sydney region. Full detail is in the privacy policy.

You must have the right to enter the information you enter — in particular, you are responsible for obtaining your customers’ consent before recording sensitive information about them, including allergies, pregnancy and photographs.

8. Leaving

You can stop using MiSuite at any time. Before you go, export what you need — the dashboard exports customers, catalogue, sales, timesheets and gift-card balances as files you can open elsewhere. Ask us and we will help.

After your subscription ends we retain your data for a period so that you can come back or ask for an export, then delete it, other than records we are required to keep. We will not delete your data without notice.

9. Suspension

We may suspend access where fees are unpaid after we have tried to contact you, where the account is being used unlawfully, or where continued use threatens the security or stability of the service for others. Suspension for non-payment never blocks the screens you need in order to pay. We will tell you why, and restore access when the cause is resolved.

10. Availability, support and what we do not promise

We aim to keep MiSuite available at all times and to answer support quickly, and during the pilot period support is direct from the person who builds it. We do not currently offer a contractual uptime guarantee, and we do not promise the service will be uninterrupted or error-free.

MiSuite depends on services outside our control — your internet connection, your card terminal, Stripe, the mobile networks, Apple and Google. We are not responsible for their failures, though we will help you work around them.

Mi POS continues to take sales while the internet is down and sends them when the connection returns. That is a safeguard, not a guarantee against all loss.

Australian Consumer Law. Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where we are permitted to limit our liability, we limit it to resupplying the service or paying the cost of having it resupplied. To the extent the law allows, we are not liable for loss of profits, loss of business or indirect loss.

11. Intellectual property

MiSuite, including its software, design and documentation, is and remains our property. Your subscription grants your business a non-exclusive, non-transferable right to use it while your subscription is current. You may not copy, resell, reverse engineer or attempt to extract the source of the software.

12. Changes

We improve MiSuite continuously, and features change. Where a change materially affects how you trade, we will tell you before it happens. We may change these terms; we will post the change here and notify you, and material changes take effect no earlier than 30 days after we do.

13. Law

These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction. If something is wrong, contact us first — most things are resolved by a phone call.
